BY USING THIS WEBSITE OR DOWNLOADING MATERIALS FROM THIS WEBSITE, YOU AGREE that you have read, understood, and agree to be bound by, all the terms and conditions on this page. If you do not agree with any of these terms, do not use this website. Unless otherwise specified, the Hayden's Cheesesteaks website is for your personal and noncommercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Hayden's Cheesesteaks website.

Hayden's Cheesesteaks Inc., together with its affiliates, (collectively referred to as “we”, “us” or “Hayden's”) may at any time, without notice, revise these terms, conditions and the content of this website generally, by updating this posting. You agree to be bound by such revisions, and are advised to periodically revisit this page to review the most current terms and conditions. Although the contents of this website are believed to be reliable at the time of posting, we cannot guarantee this information to be current, accurate or complete. All content is provided on an “as is” basis without warranties of any kind, express or implied. Your use of this website is at your own risk. Neither Hayden's nor any other party involved in creating, producing, or delivering the website is liable for any errors or omissions in the context of the website nor for any direct, special, incidental, consequential, indirect, or punitive damages arising out of your use of the website or the information contained herein.

Hayden's assumes no responsibility or liability for any viruses that may infect your computer equipment or damages to other property as a result of your use of the website or your downloading of any materials from the website. We reserve the right to change the contents of this page at any time. Because our products are perishable, all orders are subject to the terms outlined herein.

2. Privacy Policy

Hayden's is committed to using all commercially reasonable efforts in order to protect the privacy of personal information provided to us by website visitors. Personal information obtained in the course of conducting our business will not be collected, used or disclosed except in compliance with governing legislation, including Canada's Personal Information Protection and Electronic Documents Act and, for commercial electronic messages, Canada's Anti-Spam Legislation (CASL).

The primary piece of personal information we collect from you is your email address. We collect it in the following circumstances, and use it only for the purpose for which it was provided:

Placing an order. When you place an order through this website, we ask for your email address so we can send you an order confirmation, pickup-time reminders and instructions, and any event-cancellation or refund notices relating to that order. Your email is stored alongside your order record for customer-service and reconciliation purposes.

Subscribing to our mailing list. If you choose to subscribe to our mailing list (for example, from the homepage, the footer, or the notice that appears when online ordering is paused between events), we collect your email address and use it to send you occasional updates about upcoming popups, menu changes, and events. We do not use mailing-list addresses for any other purpose, and every message we send includes a one-click unsubscribe link. You can also unsubscribe at any time by emailing us at info@haydenscheesesteaks.com.

Catering and other inquiries. If you submit a catering inquiry or otherwise contact us, we use the email address you provide to reply to your request, including to send quotes and follow-up correspondence.

Creating an account. If you create an account on this website, we collect your email address (and, optionally, your name and phone number) to authenticate you and to show you your order history.

We never sell, rent or otherwise share any personal information we obtain with third parties, unless we have notified you at an e-mail address you provided that we intend to do so and we give you the opportunity to decline to have your personal information shared with the third parties. Sometimes we use agents or contractors for processing, fulfillment, or delivery of communications — including Square (payment processing), Supabase (database and account authentication), and Resend (transactional and mailing-list email delivery). Such agents or contractors are required to use your personal information only for purposes of carrying out the services they are performing for Hayden's.

We reserve the right to revise this Privacy Policy from time to time. It is your responsibility to review this Policy when you visit our website. If you do not agree with our Policy, you should cease use of this website immediately.

3. Refund Window

You may request a full refund within 48 hours of placing your order, provided the event has not yet taken place. To request a refund, email us at info@haydenscheesesteaks.com with your order number and the email address used to place the order.

After the 48-hour window has passed, all sales are final.

4. Perishable Goods

Under Ontario's Consumer Protection Act, 2002, perishable food products are exempt from the general cooling-off period that applies to certain other consumer agreements. For our popups, food is prepared fresh for each event, and cannot be resold once an order is placed.

5. Event Cancellations

If we cancel an event for any reason, all orders for that event will be refunded in full automatically. You will be notified by email at the address associated with your order.

6. How Refunds Are Processed

Approved refunds are returned to the original payment method used at checkout via Square. Please allow 5–10 business days for the refund to appear on your statement, depending on your financial institution.

7. Copyrights and Trademarks

All contents of this website are the exclusive property of Hayden's or, as applicable, entities from whom Hayden's has licensed such content, and are protected under the copyright and trade-mark laws of Canada. All rights reserved. The information on this website may not be copied (except for personal use where indicated), reproduced or distributed in any form or by any means whether electronic, mechanical, printed, photocopied, recorded or otherwise, without the prior written permission of Hayden's. Any infringement of our copyright and/or trademark rights will result in appropriate legal action.

8. Limitation of Liability

The limitations of liability in this Section 8 do not affect any liability that cannot be excluded or limited under applicable law. In no event will Hayden's or its affiliates be liable for any indirect, special, incidental, exemplary, punitive, or consequential damages (including, loss of profits, use, data, or other economic advantage) arising under, in connection with, or related to these terms and conditions, howsoever arising, either of a breach of these Terms (including breach of warranty), negligence, strict liability, tort, or any other theory of liability, even if Hayden's or its affiliates have been previously advised of the possibility of such damage. The total aggregate liability of Hayden's and its affiliates for direct damages arising under, in connection with, or related to these terms and conditions will be limited to the lesser of (a) dollar amount of the food order to which such liability relates, and (b) $10.

9. Indemnification

Upon request by Hayden's, you agree to defend, indemnify and hold harmless Hayden's and its affiliates and their directors, officers, employees, and agents against any claims, demands, actions, damages or other liabilities, including without limitation, expenses and legal fees, that arise from your use of this website. Hayden's reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Hayden's in asserting any available defenses.

10. Order Issues

If there is a problem with your order at pickup (e.g., missing items or incorrect order), please speak with our team on-site and we will endeavour to resolve it as soon as possible. You may also contact us after the event at info@haydenscheesesteaks.com.
